I Want a Divorce But I Can't Find My Spouse

We can not begin to tell you how many people come to us and say. "I want a divorce and I have not seen my spouse in 10 years".

Here is the low-down.

1. You can divorce your spouse “by publication” if you can prove to the court that you made “a valiant” effort to locate him or her. A valiant effort starts with doing a location search through an investigative service provider and ends with a final legal notice in the newspaper. If you exhaust all the required options and the court is satisfied with your effort, you will be granted a divorce without your spouses participation.

2. If you do locate your spouse through the above mentioned methods (most do), you will have to serve your spouse the initial documents you file with the court and wait to see if he or she responds (they typically have 21 to 30 days to do so). If your spouse does not respond, your divorce will proceed as a “default” divorce and if your spouse does respond, it will proceed with either his or her consent or a rebuttal to your petition or complaint.

As a rule of thumb the family law courts throughout the U.S. do not like to let people divorce their spouse without them knowing it. This being said, the divorce process is a much smoother one if your spouse can be located.
