One parent asking the other parent to help with college tuition is not out of the norm. This has been occurring more in more due to the increased popularity and necessity of a college education.
Most parents are having clauses written into the divorce settlement agreement that states the terms for the payment or contribution to college educational expenses. The number one concern of the non-custodial parent is establishing tuition caps and setting predetermined percentage. If these caps are not in writing, the judge will most likely look at the situation and decide what was more less understood and certainly what each parent is capable of paying.
If there is no mention of college tuition responsibility in the divorce settlement agreement, the support paying parent is most likely not responsible for it. Of course if taken to court, the other parent may be able to persuade the judge to modify the support order to include a contribution to the tuition.
